Terms of Service

These Terms of Service ("Terms") govern access to and use of the Rising Sphere website, store,
membership features, digital content, and related services (collectively, the "Services"). By using the
Services, creating an account, or placing an order, you agree to these Terms and the policies incorporated
by reference.
1. Eligibility
You must be legally capable of entering a binding agreement. If you are under the age of majority where
you live, a parent or legal guardian must review and agree to these Terms and supervise your use and
purchases.
2. Accounts
You must provide accurate information, keep login credentials confidential, and promptly update account
details. You are responsible for activity under your account unless caused by our failure to use reasonable
security. We may require verification, reject usernames, limit accounts, or suspend access to protect users
and the Services.
3. Intellectual Property
Unless otherwise stated, music, sound recordings, lyrics, artwork, logos, names, lore, videos, photographs,
graphics, designs, text, downloads, and other content on the Services are owned by or licensed to Rising
Sphere and protected by intellectual-property laws. No rights are granted except the limited permission to
access the Services for personal, noncommercial use.
You may not reproduce, distribute, publicly perform, publicly display, modify, create derivative works from,
sell, sublicense, scrape, train an artificial-intelligence system on, or commercially exploit content without
prior written permission or a separate license.
4. Acceptable Use
You may not violate law; infringe rights; harass others; impersonate another person; upload malware;
bypass security or access controls; interfere with operation; use bots or automated scraping without
permission; attempt unauthorized access; reverse engineer protected portions; share paid member content
outside the permitted household or account; or use the Services for fraud.
5. Store Purchases
Product descriptions, prices, availability, taxes, shipping charges, and delivery estimates may change.
Placing an order is an offer to purchase. We may accept, reject, limit, or cancel an order, including for
suspected fraud, pricing errors, stock shortages, or shipping restrictions. If an accepted order is canceled,
the amount charged for the canceled item will be refunded.
6. Digital Products
Digital music, artwork, booklets, and other downloads are licensed, not sold, for personal, noncommercial
use unless a different written license is provided. Because access may be provided immediately, digital
products are generally nonreturnable after delivery or download except where required by law or where the
file is defective and cannot reasonably be replaced.
7. Memberships and Subscriptions
Membership benefits, prices, billing periods, renewal terms, and cancellation instructions will be disclosed
before purchase. Recurring memberships renew and charge the selected payment method until canceled,
subject to the Subscription and Auto-Renewal Terms. Cancellation stops future renewals but ordinarily
does not retroactively refund a current billing period unless required by law or expressly stated.
8. User Content
If member features allow reviews, comments, profiles, images, or other submissions, you retain ownership
of your content but grant Rising Sphere a nonexclusive, worldwide, royalty-free license to host, reproduce,
format, display, and distribute that content solely to operate, improve, promote, and protect the Services.
You represent that you have all necessary rights and that your content does not violate law or another
person's rights.
9. Unsolicited Creative Submissions
Rising Sphere does not accept unsolicited songs, lyrics, recordings, scripts, artwork, stories, lore concepts,
or other creative ideas. Please do not send them. Any unsolicited material may be deleted or returned
unread without obligation.
10. Third-Party Services
Links, embeds, payment services, and other third-party features are provided for convenience. Rising
Sphere does not control and is not responsible for third-party services, content, security, or policies.
11. Disclaimers
To the fullest extent permitted by law, the Services and content are provided "as is" and "as available."
Rising Sphere disclaims implied warranties, including merchantability, fitness for a particular purpose, title,
and noninfringement. We do not promise uninterrupted, error-free, or completely secure operation. Nothing
in these Terms excludes warranties or rights that cannot lawfully be excluded.
12. Limitation of Liability
To the fullest extent permitted by law, Rising Sphere and its owners, contributors, and service providers
will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits,
lost data, or business interruption arising from the Services. Where liability cannot be excluded, total
liability will not exceed the greater of the amount you paid to Rising Sphere during the twelve months
before the event giving rise to the claim or USD $100. These limitations do not apply where prohibited by
law.
13. Indemnity
To the extent permitted by law, you agree to defend and indemnify Rising Sphere from third-party claims
arising from your unlawful use, your user content, or your violation of these Terms or another person's
rights.
14. Suspension and Termination
We may suspend or terminate access for material violations, fraud, security risks, nonpayment, abusive
conduct, or legal requirements. You may stop using the Services at any time and may request account
deletion, subject to record-retention needs.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law
principles, except where consumer law requires another result. Before filing a claim, the parties should
attempt in good faith to resolve it by contacting aoeashlyn@gmail.com. Nothing here limits rights in small-
claims court or rights that cannot be waived.
16. Changes
We may update these Terms. Material changes will apply prospectively and may be announced through
the Services or by email. Continued use after the effective date of revised Terms constitutes acceptance
where permitted by law.
